Payroll Tax Isn’t Optional — It’s a Strategic Risk

In a landmark ruling on 1 August 2025, the NSW Court of Appeal held that Uber must pay around AUD 81 million in payroll tax (plus interest) for driver payments between 2015 and 2020, overturning an earlier ruling from the Supreme Court.

What the Court clarified:

• Drivers are delivering services to the platform, not just customers. The Court found that driving—and even rating passengers—confers a tangible financial benefit to Uber, making these functions integral rather than ancillary  .
• Payment flows disguise liability. Even though Uber netted payouts (passing on rider payments minus service fees), the Court held that this doesn’t remove payroll tax obligations. The payments were still “for or in relation to the performance of work”  .
• Precedent reaching beyond rideshare. The ruling may apply across industries—medical practices, mortgage brokers, gig platforms—all of which may now face retrospective liabilities based on how they classify and manage contractor relationships
